Statement by BADIL and GPRN “Dismantling UNRWA: “The Board of Peace” Agenda”

As the Israeli regime's genocide in Gaza continues, alongside the mass forcible displacement of Palestinians across the West Bank and the systematic destruction of UNRWA's headquarters in Jerusalem and hundreds of its installations. BADIL Resource Center and Global Palestinian Refugee Network categorically reject recent political remarks made by UNRWA Commissioner-General ad interim Chris Saunders at the UNRWA Pledging Conference suggesting that UNRWA's mandate should be subordinated to externally imposed political arrangements, including the so-called "Board of Peace", or that its responsibilities could be transferred to host countries or the Palestinian Authority.

 

At the very moment that the Israeli regime, with the support of the United States, is pursuing the dismantlement of UNRWA in violation of international law, there can be no accommodation of political projects designed to facilitate its replacement. UNRWA was established by General Assembly Resolution 302 because the international community failed to implement Palestinian refugees' rights under United Nations General Assembly Resolution 194. Its mandate therefore remains exclusively under the authority of the General Assembly until those rights—including return, restitution, compensation, and reparation—are fulfilled. It cannot be transferred, conditioned, or terminated through political arrangements.

 

Against this legal backdrop, the Commissioner-General ad interim's remarks that UNRWA is essential to the Board of Peace’s activities until its services can be transferred to the Palestinian Authority is deeply alarming. Likewise, Article 14 of the New York Declaration, which envisages transferring UNRWA's services to the Palestinian Authority within a two-State framework, unlawfully subordinates the Agency's mandate to a political settlement contrary to Resolution 194. UNRWA was established neither to facilitate state-building nor to administer political transitions, but because Palestinian refugees continue to be denied their internationally protected rights.

 

The Board of Peace has itself made its objective unmistakably clear:

"UNRWA has no place in the new Gaza. We are turning the page on the complex of perpetual aid dependency and conflict. The people of Gaza deserve better."

 

This statement removes any ambiguity. The Board of Peace is the institutional vehicle for implementing the so-called GREAT Plan. What began in 2025 as proposals for "Humanitarian Transit Areas" has now evolved into fenced "Humanitarian Shelters"  in Rafah policed by foreign forces –  while the Israeli military consolidates its colonial control over the remainder of Gaza. These proposals are not humanitarian measures but mechanisms for institutionalizing forcible transfer, replacing UNRWA with externally controlled profit-driven “aid”, and transforming refugee rights into systems of containment, surveillance, and permanent displacement.

 

We call upon the Secretary-General, UNRWA, Member States, and the United Nations system to ensure that UNRWA’s mandate remains under the exclusive authority of the General Assembly, in accordance with international law and General Assembly Resolution 194, and is not subject to political conditionality imposed by any external body, including the BoP:

 

Invoke the “Uniting for Peace” mechanism

We call upon the PLO, the Arab League, and the Organisation of Islamic Cooperation to invoke the “Uniting for Peace” mechanism by convening an emergency special session of the General Assembly under Resolution 377, in order to recommend collective measures in response to ongoing violations of international law, obstruction of UN operations, and grave breaches of peremptory norms by the Israeli regime.

 

Article 6 of the UN Charter

We call upon Member States to initiate procedures under Article 6 of the UN Charter concerning the Israeli regime for persistent and grave violations of the Charter, and to ensure the immediate restoration of full, unhindered operational capacity of UNRWA across the Gaza Strip and the West Bank, including Jerusalem, in accordance with General Assembly Resolution 302 (IV), with guaranteed protection for its facilities, personnel, and humanitarian operations.

Humanitarian principles

Endorsed by UN General Assembly Resolutions 46/182 and 58/114, humanitarian principles guide the work of all actors working in the humanitarian sphere. As an Agency with a humanitarian mandate – to assist and protect Palestine refugees – humanitarian principles provide the space to make our work possible. From ensuring the sanctity of our shelters in times of crisis, to maintaining access to the most vulnerable populations, to advocating on behalf of Palestine refugees, the principles of humanity, impartiality, neutrality, and independence are at the heart of all UNRWA operations.

The four principles together drive humanitarian action. A humanitarian response requires a focus on humanity, placing those in need at the centre and addressing suffering wherever it is found, respecting the dignity and fundamental rights of beneficiaries. In response to developments in the region, the General Assembly repeatedly extends and expands the UNRWA mandate, requiring the Agency to engage in a wide variety of humanitarian, development and protection activities based on the needs of beneficiaries.

General Assembly resolution 614 (VII), in 1952, notes a need for “increased relief expenditures” in the UNRWA budget. In 1955, resolution 916 (X) notes the "serious need of other claimants for relief […] namely, the frontier villagers in Jordan, the non-refugee population of the Gaza Strip, a number of refugees in Egypt, and certain of the Bedouin”. General Assembly resolutions in 1958 and 1959 recommend that the Agency increase programmes relating to education, vocational training and self-support, an emphasis that will become an important blueprint for the Agency.

Following the hostilities of June 1967, in which 300,000 people, including some 120,000 Palestine refugees, are rendered homeless or leave their homes, resolution 2252 (ES-V) asks UNRWA to “continue to provide humanitarian assistance… on an emergency basis, and as a temporary measure, to persons in the area who are currently displaced and in serious need of continued assistance”. In later years, the General Assembly repeatedly restates the Agency’s mandate for those displaced in 1967, and, after the invasion of Lebanon by Israel in 1982, extends it to encompass those displaced by “subsequent hostilities.” In the same year, resolution 37/120 (J) explicitly adds protection to the list of UNRWA responsibilities, urging the Agency to “undertake effective measures to guarantee the safety and security and the legal and human rights of the Palestinian refugees in the occupied territories.”

From 1992 to 2002, UNRWA collaborates with the Office of the UN Special Coordinator for the Middle East Peace Process (UNSCO) and other specialized agencies of the United Nations system to contribute to the development of economic and social stability in the occupied Palestinian territory (oPt). In 1993, after Israel and the Palestine Liberation Organization (PLO) sign the Declaration of Principles on Interim Self-Government Arrangements, UNRWA begins developing its Peace Implementation Programme, which works “to meet Palestinian requests for assistance and priorities” during the interim period; General Assembly resolution 49/35 (1994) notes its “significant success.”

While other agencies and actors have the central role in arriving at a resolution of the Palestine refugee issue, UNRWA is mandated to work with governments on interim measures and to provide relief and assistance to Palestine refugees “pending the just resolution” of the Palestine refugee question.  The role UNRWA plays in the region has evolved to reflect the needs and pressures of the times, but the Agency’s central mandate remains largely unchanged: UNRWA protects and assists Palestine refugees, seeking to help them achieve their full potential in human development.

Who is UNRWA mandated to serve?

UNRWA is mandated by the UN General Assembly to serve ‘Palestine refugees’. This term was defined in 1952 as any person whose "normal place of residence was Palestine during the period 1 June 1946 to 15 May 1948 and who lost both home and means of livelihood as a result of the 1948 conflict." In addition to Palestine refugees, the UN General Assembly has also mandated UNRWA to offer services to certain other persons who require humanitarian assistance, on an emergency basis as and when required, in UNRWA fields of operations. Notably, the General Assembly has mandated the Agency to provide services to persons in the region who are currently displaced and in serious need of continued assistance as a result of the 1967 and subsequent hostilities. Sick minds and greedy people carefully thought out how best to profit from the ongoing forced displacement of the native non-Jewish men, women and children of historic Palestine.

Religious persecution is evil and wrong- basing citizenship rights and security on a person's religion is recipe for disaster and escalating violence.

Many of our ancestors came to America to escape from religious persecution. So why is America, where church and state are supposed to be fully separate, choosing to back armed Israeli bigotry, injustice and genocidal land grabs ?!

• Palestinian refugees are Palestinians who were expelled from their homes and homeland by Israel during and after the state’s establishment in 1948.

• Under international law, all refugees have a right to return to areas from which they have fled or were forced, to receive compensation for damages, and to either regain their properties or receive compensation and support for voluntary resettlement. This right derives from a number of sources, including customary international law, international humanitarian law governing rights of civilians during war, and human rights law. The UN Universal Declaration of Human Rights states in Article 13(2) that "[e]veryone has the right to leave any country, including his own, and return to his own country."
• In December 1948, following Israel's establishment based on the ethnic cleansing of approximately 750,000 Palestinians, the UN General Assembly passed Resolution 194, which states:

"refugees wishing to return to their homes and live at peace with their neighbours should be permitted to do so at the earliest practicable date, and that compensation should be paid for the property of those choosing not to return and for loss of or damage to property which, under principles of international law or in equity, should be made good by the Governments or authorities responsible."

• The right of return for Palestinian refugees has been affirmed repeatedly by the UN General Assembly, including through Resolution 3236, which "Reaffirms also the inalienable right of the Palestinians to return to their homes and property from which they have been displaced and uprooted, and calls for their return."
• The Palestinian right of return has also been recognized by human rights organizations like Amnesty International, which issued a policy statement on the subject in 2001. It concluded:

“Amnesty International calls for Palestinians who fled or were expelled from Israel, the West Bank or Gaza Strip, along with those of their descendants who have maintained genuine links with the area, to be able to exercise their right to return.”

• According to a statement issued by Human Rights Watch in 2000:

“HRW urges Israel to recognize the right to return for those Palestinians, and their descendants, who fled from territory that is now within the State of Israel, and who have maintained appropriate links with that territory.
