The ICC's request for arrest warrants has created a diplomatic dilemma for Western member states: do they support Israel or international law?

The International Criminal Court (ICC) made a historic step this week as chief prosecutor Karim A. A. Khan KC sought arrest warrants for leading Israeli officials, including Prime Minister Benjamin Netanyahu and Defence Minister Yoav Gallant, along with three senior Hamas officials.

Beyond adding further political pressure on Israel over its onslaught in Gaza, there is also the question of how significantly the arrest warrants will impact Israel’s Western allies, who have faced mounting scrutiny over their support for Israel.

Unsurprisingly, both Israel and Hamas condemned the move by Khan, who said the named figures “bear criminal responsibility”. Israeli ministers labelled the decision as “outrageous” and a “moral outrage,” while criticising the equivalency with Hamas, which committed its deadly attack on 7 October....

What can the ICC do?

The ICC is the first and only permanent international criminal court, aimed at deterring and punishing the most serious crimes, such as genocide, crimes against humanity, war crimes, and aggression. Established by the 1998 Rome Statute, the court officially came into force on 1 July 2002.

The statute, now joined by 124 countries including founding members such as the UK, France, Germany, Italy, the Netherlands, Canada, Australia, Belgium, Norway, South Africa, and Japan, obliges parties to arrest individuals with warrants.

Israel, supported by the US and UK governments, has claimed the ICC has no jurisdiction over it, as it is not a party to the statute. However, in 2021, the ICC ruled that Palestine would be considered a state party to the ICC statute for the purposes of the treaty.

That means the ICC will have jurisdiction over an Israeli if they commit war crimes against a state party, in this case, Palestine.

If individuals with warrants are apprehended, it may take years to conduct trials, with a long process of gathering and preserving evidence, which may require the consent of states to access territory.

“None of us would expect Gallant and Netanyahu being taken away soon, even if arrest warrants are issued and Israeli courts are declared incompetent into looking into it,” Shahd Hammouri, lecturer in international law at the University of Kent, told The New Arab.

“The named Israeli officials would only be unable to travel to states that aren’t members of the ICC, but it wouldn’t mean they directly go to prison.”

Increased pressure on the West

Despite the legal technicalities, Israel’s Western partners may realise that they are at a crossroads, torn between supporting the rule of law or upholding their ties to Israel.

Juliette McIntyre, lecturer in law at the University of South Australia, said the arrest warrants will therefore put heavy political pressure on Israel’s Western partners, including over arms sales.

“It impacts significantly on one's standing in the international community which is why this is more significant in respect of Netanyahu and Gallant than the Hamas leadership, since Hamas is already a designated terrorist organisation in many countries,” she told The New Arab.

She added that this does not create an equivalence between Hamas and Netanyahu however, adding “the standard is the law, and that is what each party's conduct will be assessed against regardless of what the other ‘side’ to the conflict is doing”.

As many would expect, the US has also strongly condemned Khan’s request, with US Secretary of State Anthony Blinken indicating Washington may prepare to sanction ICC figures.

Israel raids, forces medical staff to leave Gaza Al-Awda Hospital... "More than 35,700 Palestinians have been killed in Gaza, the vast majority being women and children, and nearly 80,000 others injured since October."

The Israeli occupation military stormed Al-Awda Hospital in Gaza and forced the medical staff to evacuate after a four-day siege.

According to Wafa news agency, Israeli occupation soldiers detained a medical worker and forced the remaining staff to evacuate towards the Western Gaza City area.

However, several doctors have refused to leave without an ambulance to safely evacuate the 14 injured patients, who remain trapped in the hospital.

The attack follows concerns expressed earlier this week by the World Health Organisation director-general regarding the safety of patients and staff at Al-Awda Hospital.

“Al-Awda Hospital in northern Gaza has been under siege since 19 May, with no one allowed to leave or enter; 148 hospital staff, 22 patients and their companions are still trapped inside,” said Tedros Adhanom Ghebreyesus.

He noted that medical staff inside the hospital reported an attack on Monday, “with snipers aiming at the building and an artillery rocket hitting the fifth floor, where the administration department is located.”

“We are deeply concerned about the safety of the remaining patients and hospital staff,” he added. “We appeal for their protection, for humanitarian access and an immediate ceasefire.”

More than 35,700 Palestinians have been killed in Gaza, the vast majority being women and children, and nearly 80,000 others injured since October.

Nearly eight months into the Israeli war, vast swathes of Gaza lay in ruins amid a crippling blockade of food, clean water and medicine.

Israel stands accused of genocide at the International Court of Justice (ICJ) which, in January, issued an interim ruling that ordered it to stop genocidal acts and take measures to guarantee that humanitarian assistance is provided to civilians in Gaza.

'Where are our loved ones?': Palestinians in search of missing family members amid Gaza war

Amid the chaos of Israel's ongoing war in Gaza, Palestinian families share their struggles with locating missing loved ones.

The Al-Mansi family stands as a poignant testament to the agony of the missing amid the Israeli war.

Five months have passed since Hazam Al-Mansi, a father and grandfather of 13, vanished without a trace, leaving an incomprehensible void.

“Hazam was the pillar of our family, the father, the support; he was everything to us,” says Fatina Al-Mansi, Hazem’s wife, her voice breaking with tears.

“Every day, I weep for my daughters. We have four daughters and two sons, and each one bears the burden of their father's absence differently.”

For Hazam's daughters, the pain of his absence is profound, their tears a daily reminder of the void left by his disappearance.

“We long to hear his voice, to feel his comforting embrace once more, to hug him,” says his eldest daughter, her voice trembling with sorrow.

Palestinians in Rafah struggle to figure out where to go

Hazem, 60, suffers from chronic diseases and nerve allergies, requiring ongoing treatment. However, due to the Israeli war in Gaza, medications have depleted in pharmacies, and many have closed. Additionally, UNRWA health clinics have been shut since October 7.

“We searched everywhere for treatment, but it was not available. Most medications were running out of pharmacies. Without his nerve treatment medication, Hazem’s nerves began to spasm,” explains Fatina.

“Hazem’s condition worsened over the next thirteen days after treatment was interrupted. One day, our neighbour told us there was a pharmacy open in the Al-Rimal neighbourhood. As soon as Hazem knew that, he quickly went there without waiting. I asked him to wait for one of our sons to go, but he refused,” she continues.

"I pray every night for his safe return, hoping for reassurance... We long to know his fate, whether he is alive or dead. At the very least, we wish to provide him with a proper burial"

Conditions in the Al-Rimal neighbourhood were exceedingly challenging and dangerous, compounded by the Israeli army's westward expansion of ground operations in Gaza City.

Since November 6, Hazam Al-Mansi has been missing. He went out and did not return.

“We do not know where he is or what happened to him,” says his wife, her heart heavy with grief.

“We have searched every corner, every shelter, hoping to find even a shred of information,” she whispers, her hands trembling with emotion. “But all we are met with is silence.”

In their search for answers, the Al-Mansi family reached out to the International Committee of the Red Cross (ICRC), hoping for assistance in locating Hazam. Yet, their inquiries have yielded no response, leaving the family in uncertainty.

“I pray every night for his safe return, hoping for reassurance,” his wife expresses. “We long to know his fate, whether he is alive or dead. At the very least, we wish to provide him with a proper burial,” she says.

“Don't they say that honouring the dead is burying him? I want to bury him. I want him to have a grave so that we can remember him and that his children and grandchildren can visit him.”

Euro-Med Human Rights Monitor estimates that more than 13,000 Palestinians are missing, either buried under rubble, victims of indiscriminate mass graves, or forcibly hidden in Israeli prisons and detention centres. Some may have been killed within these facilities.

The Israeli army has not released any information regarding the circumstances of these deaths. Independent bodies have not been able to verify or ascertain the circumstances, and the bodies have not been recovered, identified, or returned to their families.

Uncertainty and fear for Nael Al-Yazji

In the heart-wrenching story of the Al-Mansi family, another plight unfolds. Nael Al-Yazji's wife describes bearing her anxieties like a mountain.

“We've endured every aspect of this Israeli genocide. We face hunger, fear, death, and anxiety daily. Living under constant bombardment has become our norm,” says Dana, Nael Al-Yazji's wife.

“We've witnessed the suffering and fear etched on our children's faces. Yet, nothing compares to the agony of not knowing Nael's fate,” she continues.

In late March, Israeli forces invaded Al-Shifa Hospital in Gaza City, committing atrocities against civilians both inside and nearby.

Nael Al-Yazji, 32, had sought refuge in his family home nearby. However, Israeli forces violently raided their home, kidnapping men and forcibly relocating women southward.

"To this day, I know nothing about Nael, whether he was killed or captured"

Dana’s harrowing recollection paints a vivid picture of the night terror descended upon their home. “The army suddenly stormed in,” she recounts. “More than 20 soldiers, accompanied by dogs, unleashed a barrage of gunfire to instil fear. Then, they swiftly blindfolded and restrained us.

“At that moment, I was separated from my family — my husband and children — surrounded only by the cacophony of screams and cries,” she recalls.

Decades of spying and repression: the anti-Palestinian origins of American Islamophobia - It’s often assumed that Islamophobia is the driving force behind US anti-Palestinian bigotry. In fact, it’s the other way around

"In 1985, a series of linked bombings targeted the American-Arab Anti-Discrimination Committee (ADC), which advocated prominently for Palestine. The organization’s Boston office was bombed, injuring two people, and later that year, Alex Odeh, the west coast director, was killed when a pipe bomb exploded as he opened the door to his office. Two suspects in Odeh’s assassination, associated with the Kahanist Jewish Defense League, fled to Israel, where they have since lived openly in West Bank settlements. One of them, Andy Green (who now goes by Baruch Ben-Yosef), has also been identified as a lead civilian organizer of recent protests blocking humanitarian aid shipments into Gaza."

One evening last Thanksgiving weekend, three 20-year-old Palestinian college students were strolling around Burlington, Vermont, when they were suddenly gunned down by a stranger. One of the victims, Hisham Awartani, is now paralyzed from the waist down. Since they were wearing keffiyehs and speaking Arabic and English, speculation ran high that the young men had been victims of an Islamophobic attack.

The BBC noted that the attack “comes as the US deals with a surge in Islamophobia and antisemitism since the start of the Israel-Gaza war”. Vermont’s Middlebury College described the shooting as evidence of “a marked increase in Islamophobic acts on American campuses and beyond”. A White House statement mentioned how “far too many people live with the fear that they could be targeted and attacked based on their beliefs or who they are”.

But that’s not how Elizabeth Price, the mother of Awartani, seemed to understand the attack. She told WNYC radio that she had raised three children in the West Bank, where children routinely encounter Israeli state and settler violence, and she never believed Hisham would be targeted in the US. Diplomatic Missions in Jerusalem and Ramallah condemn escalating settler violence and displacement during visit to Northern Jordan Valley communities

Representatives from Belgium, Canada, Denmark, European Union, Finland, France, Germany, Italy, Netherlands, Sweden, and the United Kingdom, made a joint visit to the Palestinian communities in the Northern Jordan Valley, yesterday, in light of the alarming increase in settler violence and forced displacements. Ireland supports this statement.

During their visit, diplomats witnessed first-hand the distressing impact of settler violence on Palestinian communities, including the recent displacement of families in As-Sukhun community following relentless attacks from Israeli settler outposts and the destruction of multiple properties in Al-Jiftlik area neat Jericho. The delegation also condemned the recent declaration of 800 hectares of land as state land in Aqraba by Israeli authorities, exacerbating the coercive environment faced by these communities.

The delegation expressed deep concern over the surge in settler violence, which has led to numerous displacements and casualties throughout the West Bank, including the Jordan Valley.

While acknowledging some measures, recently announced, taken by Israeli authorities, the diplomats stressed the need for effective implementation and more robust actions to hold perpetrators of settler violence accountable and prevent further intolerable situations for Palestinians. Diplomats call on Israel to respect all its obligations under Article 49 of the Fourth Geneva Convention, including the prohibition on forcible transfer, and reiterated their opposition to illegal settlements, which fuel violence and impede the two-state solution.

Diplomats reaffirmed their commitment to upholding Palestinian rights and assisting vulnerable populations in Area C, emphasizing the need for Israel, as the occupying power, to ensure the safety of all Palestinian communities living in Area C. The aforementioned representatives condemned all acts of violence, emphasizing the need for a peaceful resolution to the conflict and the protection of civilian lives on all sides.

The pretext of counter-terrorism as a reason to investigate Americans started with ‘red squads’, Huac and J Edgar Hoover

On Monday, 13 May, the Israeli historian and professor Ilan Pappé landed in Detroit, Michigan. Upon his arrival, agents from the US Department of Homeland Security detained and interrogated him for two hours. According to Pappé, DHS asked him whether he was a Hamas supporter, whether he believed Israel was committing genocide and what his “solution” to the Middle East conflict was. Agents also reportedly asked him to identify “his Arab and Muslim friends in America”.

During his interrogation, DHS agents held a long phone conversation, which Pappé speculated may have been with Israeli officials. Pappé was eventually admitted to the US, but only after DHS copied the entire contents of his cellphone. (Initially, Pappé reported he had been interrogated by the FBI; he has since clarified that it was agents of the DHS.)

Pappé is a respected academic known for his scholarship arguing that the expulsion of Palestinians during the Nakba was a deliberate act of ethnic cleansing central to Israel’s creation. Pappé is also known for his anti-Zionist politics. There is nothing to suggest any connection between Pappé and Hamas.

In the US, however, counter-terrorism authorities are often deployed to surveil political speech. Opponents of Palestinian rights both within and outside government frequently conflate political views they dislike with terrorism. This demonizes supporters of Palestinian rights in the public sphere and paves the way for the type of government harassment to which the DHS subjected Pappé. Such actions are part of both the McCarthyite atmosphere those with pro-Palestinian politics face and the broader history of political policing in the US.

The humanitarian crisis in Gaza is set to worsen once again as deliveries of aid and fuel to the Palestinian territory slow to a trickle in the wake of Israel’s two-week-old ground offensive in the southern city of Rafah.

The UN has suspended food distribution in Rafah owing to a lack of supplies and insecurity, the world body said late on Tuesday, and delivery operations from the new US-funded floating pier have also been halted after desperate people seized most of the shipment offloaded on to trucks on Saturday, an incident in which one person was killed.

Since 10 May, shortly after Israel seized control of the Rafah crossing with Egypt, through which the majority of aid to Gaza flows, only about three dozen trucks have successfully been delivered via the nearby Kerem Shalom crossing, and only about a quarter of the allowed fuel has been delivered since the Israeli operation began.

Palestinian refugees in Gaza- AFSC Defending a displaced people

When the 1948 Arab-Israeli War left nearly 250,000 Palestinian refugees stranded in Gaza, the United Nations turned to AFSC to help organize relief services. Early in 1949, 20 AFSC staffers faced a sea of people and began distributing food, clothing, tents, and blankets. Ultimately, a renowned African-American physician, Dr. Jerome Peterson, came to manage medical care.

While staff from other relief agencies lived apart in guarded houses, the Quakers “lived as close as we could … open and present and among the people all the time.” By 1950, when the United Nations took over, more than 100 AFSC staffers had worked in Gaza—most of them in their 20s and early 30s. They had managed to help Palestinians create schools, maternity centers, metal shops, and recreation clubs.

Camps were roughly grouped around three cities: Gaza (the largest), Khan Younis, and Rafah.

The cold, rainy winters in Gaza made adequate shelter essential.

Even with donated blankets, nights were so chilly that people often huddled together to stay warm.

Lentils and beans supplemented flour and oil in the refugees’ meager diets.

Initially, children had no writing tools. They learned by reciting aloud and sat on the mats, sacks or the ground.


Even in these surroundings, “they had the boundless eagerness of school children everywhere,” wrote one volunteer.

"The US is, by far, the biggest supplier of arms to Israel, providing $3.8bn in military aid per year – and it’s all paid for by American taxpayers. (Israel is also the largest aggregate recipient of US foreign aid in the world, having received about $300bn since the Jewish state was founded in 1948.) Last month, after intense lobbying by Biden, Congress approved $26bn in additional support to Israel, which includes $14bn in unconditional military aid.

Biden and his top aides passed up another opportunity this month to restrict most arms shipments and end US complicity in Israel’s war. On 10 May, the state department sent a long-awaited report to Congress in which the administration must certify that recipients of US weapons are abiding by international law and allowing the transport of humanitarian aid during active conflicts. The administration said it found written assurances from Israeli officials that they would use US arms in accordance with international humanitarian law to be “credible and reliable”.

The 46-page report was an exercise in bureaucratic double-speak, and it showed how far the Biden administration is willing to contort itself to avoid concluding that Israel violated any international laws, or had intentionally obstructed humanitarian aid into Gaza. Either of those findings would have shown that Israel had violated a new national security memo that Biden issued in February, and required the administration to suspend or restrict most arms shipments to Israel under existing US laws.

The state department report, which contradicted itself in numerous places, argued that the US could not find hard proof that Israel had used US weapons in specific incidents that might have involved human rights violations. But for months, numerous rights groups and independent monitors have documented Israel’s violations of international law, including its use of starvation as a weapon of war and methodical campaign to obstruct the delivery of food and other aid into Gaza." Dear President Biden... Connect The Dots

@UNRWA estimates that around 800,000 people have fled Rafah since Israel's military operations intensified. Families flee looking for safety, but living conditions deteriorate by the day and no place is safe in the Gaza Strip.

Dear President Biden,

"Democracy worthy of our dreams starts with opening the doors for every one without exceptions." Biden's speech at Morehouse College May 2024 graduation ceremonies.

During the 1930s-1970s maps were made and Federal Loans were denied to red lined Black neighborhoods. Eventually, through the efforts of organizers like Dr. Martin Luther King Jr. and the resulting protests, the Civil Rights Act was signed in 1964, outlawing discrimination, though desegregation was a slow process, especially in schools.

YES, democracy worthy of our dreams MUST open doors for everyone without exception.

Slavery and segregation are all wrong. Please connect the dots... real democracy needs our support, not Israel.

Israel has targeted and murdered multiple Palestinian journalists, stifled free speech, violated international law, imprisoned countless Palestinian men, women & children, and freely bombs universities, bookstores, businesses, neighborhoods, refugee camps, roads, cars, schools, restaurants, and other countries over and over again.

Israel, fully funded by America, punitively demolishes Palestinian homes, destroys Palestinian communities, and kills Palestinian men, women and children.

Why is Atlanta building a $90 million dollar Israeli inspired "COP CITY" usurping 100 acres of forest to create a tactical training compound featuring a mock city?!

Why are American police forces being trained by Israel?!

There is a better way forward, for everyone: Enough with foolishly wasting American money on Israel and COP CITY antics.

Fund true community needs- not Israel. Start honoring basic human rights and respect for all people, regardless of supposed race or religion.

No more delusions for Israel. No more support for Apartheid Walls, IDF checkpoints, conniving Zionist propaganda, and COP CITY vice.

Enough with destroying hopes and dreams here and in Palestine.

Invest in goodness- not Israel.

Where, after all, do universal human rights begin?

The UN Mediator for Palestine, Count Folke Bernadotte, believed that the Palestinians displaced had a right to return to their homes and wrote several UN reports to that effect.

"It would be an offence against the principles of elemental justice if these innocent victims of the conflict were denied the right to return to their homes while Jewish immigrants flow into Palestine, and, indeed, at least offer the threat of permanent replacement of the Arab refugees who have been rooted in the land for centuries."

Bernadotte was assassinated on Friday 17 September 1948 by members of the group Lehi, a Zionist terrorist organization, commonly known in the West as the Stern Gang
